Terms of service
Last updated:
In plain English
- Josie answers your business's calls with AI. You set it up, and you stay responsible for what it is set up to do.
- You agree to use Josie lawfully, including getting the consent your callers' texts and recordings need.
- Josie is not an emergency service and gives no medical, legal or financial advice.
- You pay a monthly or yearly plan, plus any minutes over your plan. You can cancel any time; the plan runs to the end of the period you paid for.
- Your business's information stays yours. We use it only to provide Josie, as our privacy policy describes.
The agreement
These terms are an agreement between [Company legal name] ("Josie," "we," "us") and the business that signs up for Josie ("you"). By creating an account or using Josie, you accept these terms on behalf of your business, and you confirm you have the authority to do so. Our privacy policy and our SMS terms are part of these terms. For healthcare businesses, the Business Associate Agreement we sign with you is part of them too.
What Josie does
Josie is an AI receptionist. It answers the calls you forward to it, answers questions using the information you give it, books appointments, takes messages, sends texts on your behalf, transfers calls to the people you choose and sends you summaries. We may improve or change Josie over time. If a change removes something important you pay for, we will tell you first.
Your account
- Keep your login details safe and tell us right away if you think someone else has used your account.
- You are responsible for what happens in your account, including what your team members do.
- The information you give Josie must be accurate. Josie tells callers what you set up, so keep your hours, prices and policies current.
Your responsibilities to callers
- Consent and notices. Josie tells every caller it is an AI assistant and that the call is recorded and transcribed. You are responsible for any other consent or notice the law requires where you operate, including consent to receive text messages.
- Text messages. You agree to follow our SMS terms and the telephone and text-messaging laws that apply to you, including the Telephone Consumer Protection Act.
- Transfers. Transfer numbers must be lines you control, and different from the line you forward to Josie.
What Josie is not
- Not an emergency service. Josie can't contact 911 or emergency services for anyone. Healthcare and home-service agents tell callers in an emergency to hang up and call 911.
- No professional advice. Josie doesn't give medical, legal or financial advice, and you must not set it up to.
- AI can make mistakes. Josie may sometimes misunderstand a caller or give an incomplete answer. Review your calls and summaries, and correct Josie's information when it's wrong.
Healthcare
If your business handles protected health information, you must tell us and turn on healthcare mode before Josie takes calls with health information, and we must both sign a Business Associate Agreement. Until then, don't use Josie for calls that involve health information.
Fees and payment
- You pay the plan you choose, monthly or yearly, in advance, plus any minutes over your plan's included minutes at your plan's rate.
- A free trial, if offered, turns into your paid plan at the end of the trial unless you cancel before then.
- Prices are in US dollars and don't include taxes, which we add where the law requires.
- Fees are not refundable except where the law requires, or where these terms say otherwise.
- If a payment fails, we will tell you and try again. If it still fails, Josie may limit service to taking messages before we suspend your account.
Your data
Your business information and your callers' information belong to you. You give us permission to use it only to provide, secure and improve Josie, as our privacy policy describes. You can export your data while your account is active. After you close your account, we delete it as our privacy policy describes.
Acceptable use
You agree not to use Josie to:
- break any law, or harm, harass or deceive anyone;
- make or send calls or texts that are unsolicited marketing, or that lack the consent the law requires;
- collect information you aren't allowed to collect;
- interfere with Josie, or try to get into accounts or systems that aren't yours;
- copy, resell or reverse-engineer Josie.
Third-party services
Josie relies on other services, such as telephone carriers, voice AI providers and calendars you choose to connect. Their own terms apply to them, and we aren't responsible for outages or changes on their side, though we work to keep Josie answering when they fail.
Suspension and ending the agreement
You can cancel at any time in the app; your plan runs to the end of the period you paid for. We may suspend or end your account if you seriously break these terms, don't pay, or use Josie in a way that puts callers, carriers or Josie at risk. When possible, we will warn you first.
Disclaimers
Josie is provided "as is." To the extent the law allows, we disclaim all warranties not stated in these terms, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that Josie will answer every call or never make a mistake.
Limitation of liability
To the extent the law allows, neither of us is liable for indirect, incidental, special or consequential damages, or for lost profits or revenue. Our total liability for any claim under these terms is limited to the fees you paid us in the 12 months before the claim.
Indemnity
You will defend and indemnify Josie against claims that arise from how you set up or use Josie, including claims about consent for calls, recordings and texts.
Governing law
These terms are governed by the laws of the State of [State], without regard to its conflict-of-law rules. Any dispute goes to the state or federal courts in [County, State].
Changes to these terms
